Updated implementing regulation (EU) 2024/1975 amending the MED in force from 4 September 2024

The 8th Implementing Regulation (EU) 2024/1975 of 19 July 2024 amending the Marine Equipment Directive (MED) 2014/90/EU was published in the Official Journal of the EU. The Implementing Regulation (EU) 2024/1975 will come into force on 4 September 2024 and repeal the 7th Implementing Regulation (EU) 2023/1667.

What is new in the updated Implementing Regulation? 

Marine equipment listed as a ”new item inserted by Implementing Regulation (EU) 2024/1975” in column 1 of the Annex, which is in compliance with the national requirements for type-approval in force before 4 September 2024 in a Member State, may continue to be placed on the market and on board an EU ship until 4 September 2027.

The 8th Implementing Regulation (EU) 2024/1975 contains the following new MED items which will be applicable for “first placing on the market” from 4 September 2024:

  • MED/4.67 Electronic Inclinometer Equipment
  • MED/4.63 GNSS Equipment- new sub-item: SBAS Equipment

Furthermore, for some maritime equipment, new or updated testing standards have been introduced as indicated by “(NEW ROW)” in column 1 and are applicable for the “first placing on the market” from 4 September 2024; as shown in this example:

For the following marine equipment, new or updated standards have been introduced: 

  • MED/1.19 - Inflated rescue boats
  • MED/1.20a - Fast rescue boats: -inflated
  • MED/1.20c - Fast rescue boats: -rigid-inflated
  • MED/2.7 - Shipboard incinerators (Incinerator plants with capacities up to 4000 kW)
  • MED/3.3a - Fire-fighter’s outfit: protective clothing (close proximity clothing)
  • MED/3.15b - Materials other than steel for pipes conveying oil or fuel oil: -valves
  • MED/3.30a - Portable oxygen analysis and/or gas detection equipment: - category 1: (safe area)
  • MED/3.30b - Portable oxygen analysis and/or gas detection equipment: -category 2: (explosive gas atmospheres)
  • MED/3.40 - Low-location lighting systems (components only)
  • MED/3.49a - Fixed water-based fire-fighting systems for roro spaces, vehicle spaces and special category spaces: -prescriptive-based systems as per IMO MSC.1/Circ.1430, Revision 3
  • MED/3.49b - Fixed water-based firefighting systems for roro spaces, vehicle spaces and special category spaces: - performance-based systems as per IMO MSC.1/Circ. 1430, Revision 3
  • MED/3.54b - Fixed oxygen analysis and/or gas detection equipment: — category 3: (explosive gas atmospheres)
  • MED/3.55b - Dual purpose type nozzles (spray/jet type):- Hand-held branch pipes for fire service use – Smooth bore jet and/or one fixed spray jet angle branch pipes PN 16 (Note: Minimum spray angle of 30°)
  • MED/3.57 - Medium Expansion Foam Fire Extinguishing Systems components: -Fixed Deck Foam for Tankers
  • MED/3.58 - Fixed Low Expansion Foam Fire Extinguishing Systems Components for Machinery Spaces and Tanker Deck Protection
  • MED/3.62 - Dry chemical powder extinguishing systems
  • MED/3.65 - Fixed hydrocarbon gas detection system
  • MED/4.6 - Echo-sounding equipment
  • MED/4.30 - Electronic chart display and information system (ECDIS) with backup, and raster chart display system (RCDS)
  • MED/8.1 - Water level detector.

Certification and Declaration of Conformity

Manufacturers need to have valid MED certification (Module B+D, B+E, B+F or Module G certificates) to be allowed to place their products on the European market. The conformity of the products is confirmed by the manufacturer at the end of the production phase by affixing the wheel mark on the product and issuing a Declaration of Conformity. 

The Declaration of Conformity issued by the manufacturer for products produced after 4 September 2024 shall follow the 8th Implementing Regulation.

Manufacturers are requested to compare the conformity of their products with the design, construction and performance requirements as well as with the testing standards of the currently valid Implementing Regulation. For products where changed requirements and testing standards are introduced, new or additional tests may be required.

As of 4 September 2024, MED certificates will be issued by DNV’s notified bodies according to the 8th Implementing Regulation after a positive outcome of the EC assessment procedure.

Recommendations

DNV recommends that its customers inform themselves and become familiar with the updated Implementing Regulation as published in the Official Journal of the EU.
